Where is EPA with 8-hour Ozone designations?
  • Memo from EPA’s Office of Air and Radiation dated November 14, 2002 outlining schedule for designations
  • EPA will begin process using 2000-2002 data.  2001-2003 will be used to the extent it is available and quality assured.
  • Earlier guidance (March 28, 2000 memo) for designations will be used.

8-Hour Ozone NAAQS Rulemaking
  • Current timeline for implementation:
    • Expected Rule proposed early 2003
    • Final rulemaking late 2003/ early 2004
    • 8-hour designations in 2004
    • State Implementation Plan (SIP) due 3 yrs from designation.  (SIP potentially due by 2007 demonstrating attainment, if marginal classification, within 3-yrs or by 2010)
    • Transportation Conformity begins 1 yr after designation
    • Expectations for some -to significant -‘overlap’ of 1 & 8-hr standards

What is an Early Action Compact?
  • A Voluntary Effort to Achieve and Maintain the 8‑Hour Ozone Standard Through the Development and Execution of an Early Action Plan.
  • Concept Cooperatively Developed by TNRCC and EPA, with Input From Environmental Stakeholders
  • Protocol for Developing Compacts Approved by the EPA on June 19, 2002.
    •  EPA’s November 14th memo provides more details.
    • MUST BE SIGNED BY DECEMBER 31, 2002

  • Expeditious Attainment and Maintenance of the 8‑hour Ozone Standard Through Early Planning and Implementation of Emission Reductions
  • Local Control of Clean‑Air Measures, with Broad‑Based Public Input
  • State Support to Ensure Technical Integrity of the Early Action Plan

Who Can Participate?
  • Areas That Are in Attainment of the 1‑Hour Ozone Standard, Including No Monitored Violations, But Approach or Monitor Exceedances of the 8‑Hour Ozone Standard
  • In Region 6, the following areas have already submitted draft compacts:
    • Oklahoma: Tulsa
    •  Texas: Austin, San Antonio, Tyler/Longview
    •  Louisiana:  Shreveport

  • Formal Incorporation of Early Action Plan Into the State Implementation Plan
  • Deferral of the Effective Date of Nonattainment Designation, Provided Compact Milestones are Met
  • Return of Area to Traditional SIP Requirements if the Compact is Unfulfilled, with Appropriate Credit for Measures Implemented
